Terms of use

1. The use of any information on this website is conditional on your acceptance of these terms without modification. If you do not wish to accept them, please do not use this website. We ask that you read these terms carefully and print them out for future reference.

2. References to “you” and “your” mean all persons using this website. “We”, “us” and “our” means Las Ramblas and its proprietor(s). “Owner(s)” means the respective owner(s) of the properties we feature.

3. Our role is to market properties, check availability of properties, take bookings, collect payment on behalf of owners and assist with associated services to ensure your holiday runs smoothly. We act as agent for the Owners. Our liability extends solely to the proper administration of these matters and complaints on any of the above should be directed to us.

4. The property details contained on this website are provided and approved by the owner and appear in good faith. We rely on owners to notify any changes to us and, although we aim to view properties marketed with us and maintain regular contact with owners, we cannot guarantee all changes made are notified to us. All property advertised is subject to availability and confirmation of the booking by owners and no warranties, promises or representations are given as to availability.

5. We hope you will make a booking through our website. Should you do so, your contract will be with the owner and is made subject to booking conditions between you and the owner. We have provided a set of standard terms to owners and these are available on this website for you to read and print out prior to booking. By all owners using the same terms we can ensure that certain standards are maintained, however, occasionally property specific terms may need to be included and we will notify these to you where we are aware of them. Please note that it is your responsibility to make relevant enquiries through us, acting on behalf of the owner, should you have any specific requirements.

6. By marketing property on this site we are inviting you to make an offer to the owner to book the property offered for holiday rental. Once you send a completed Booking Form to us you have made an offer to book the property from the owner for whom we are acting as agent. We check with the owner whether they accept your offer and are authorised by the owner to communicate their response on their behalf. Acceptance occurs when we send you written confirmation. At this stage there is a binding contract between you and the owner.


7. No warranties or representations of any kind, express or implied, are given as to the accuracy or completeness of any of the information contained in this website or as to the nature, standard or suitability or otherwise of property or any services offered by us on behalf of owners or other third parties. We shall not be liable to you for any direct, indirect or consequential loss, loss of profit, revenue or goodwill arising from your use of this website or any information on this website including any inability to access or use this website.

8. We attempt to ensure that the content of this website is accurate, however, it may include inaccuracies, typographical errors and omissions. If you believe any information on this website to be inaccurate please advise us. We will do our best to investigate and correct mistakes as quickly as possible. Where information is obviously incorrect (such as price band information) neither the owner nor us will be bound by it. Changes such as additions, deletions and amendments are periodically made to this website and improvements and/or changes may be made to the functionality, design or layout at any time without prior notice.

9. All exclusions of liability apply only to the fullest extent permissible by law. This does not affect your statutory rights as a consumer.

10. The content of this website is for personal, non-commercial use. You warrant that you are at least 18 years old and have the legal authority to use this website in accordance with these terms. You agree to be financially responsible for any charges and other sums of whatever nature which arise out of your use of this website.

11. Copyright in the material contained in this website belongs to us or our licensors. No part of this website can be used or reproduced without our prior consent, other than temporarily in the course of using our services or to keep a record of a transaction you have entered into with us.

12. All information contained in this website and all matters which arise between you and us will be governed by English law, wherever you are based. Any dispute will be dealt with exclusively by the Courts of England and Wales.

13. This website contains links to other sites. Except where they belong to us such linked sites are not under our control. Linked sites are provided for your convenience, information and in some cases transactional capability only and you access them at your own risk. You may not establish a hyperlink to this website or provide any links that state or imply any advertising, sponsorship or endorsement of your own website by us. We make no warranty that this website, and linked sites, are free from technical errors, computer viruses or anything else that has contaminating or destructive properties.

Privacy Policy

We treat your privacy seriously. This policy will explain how we collect and use your personal data.

In order to process your enquiry or booking we will collect data from you including your name (or the party leader’s name) and contact details (such as address, e-mail, telephone number). We will correspond with you regarding your enquiry or booking using these details. You may need to provide us with details of bank accounts in order to make payments to us. These details will only be used for the purposes for which they were provided.

Occasionally you may need to give us sensitive personal data within the meaning of the Data Protection Act 1998 (for example about your health where you make a particular request for property that meets a medical need). Any such information will only be disclosed with your express consent.

We will process all data that we collect and hold on you in accordance with applicable law. We have appropriate security measures in place to protect your data.

We may also need to pass your details to third parties (for example the owner of the property you have booked) who need to know them to deal with your enquiry or to process part of your booking. Such third parties may contact you directly using the contact details you have provided.

We may contact you from time to time with holiday information we consider you may be interested in, unless you tell us you do not want to receive this information. We do not sell or rent your details to third parties so they can use your data for direct marketing purposes.

You may also join our mailing list to receive details of special offers and promotions. All promotional e-mail we send you will tell you how you can decline future mailings.

Your use of this website signifies your consent to us collecting and using personal data about you as set out in this policy. Should we change this policy for whatever reason, the changes will be posted here so that you are always aware how we collect and use your personal data.

Booking Conditions

The following Booking Conditions together with the general information contained on the LasRamblas.info website form the basis of your contract with the owner (“Owner”) of any property you book for holiday accommodation (“Property”). Please read these carefully as all bookings are made subject to these conditions.

Paul Bailey trading as Las Ramblas (“Las Ramblas”) arranges bookings of properties as agent of the Owner of such properties (“Property”). When you book Property through LasRamblas.info you enter into a contract with the Owner of the Property.

Las Ramblas is responsible for the administration of your booking but, except where otherwise stated in these conditions, does so solely on behalf of and as agent of the Owner. Where these conditions mention Las Ramblas without using words such as “on behalf of the Owner” or “on our behalf” this means Las Ramblas in its own right.

References to “you” and “your” mean the person making the booking and all members of the holiday party. References to “we” and “our” mean the Owner. Nothing in these conditions affects your normal statutory rights.

1. Making your booking

All offers and bookings are subject to availability. The party leader must be at least 18 and confirms that he/she is authorised to make the booking on the basis of these Booking Conditions by all persons who are subject to the booking. Written confirmation of the booking will be sent by Las Ramblas on our behalf. When you receive your confirmation, the details must be checked carefully. If anything is not correct, you should immediately notify Las Ramblas on our behalf.

2. Payment for the Property

The party leader is responsible for making all payments due. A deposit of 25% of the full booking price is due within 7 days of the confirmation. This deposit is non refundable in the event of your cancellation or failure to pay on time as set out below. The balance is due to be paid 8 weeks prior to commencement of your stay. If your booking is made within 8 weeks of commencement of your stay the full booking price is due immediately after confirmation.

Payments are made to Las Ramblas on our behalf.

If you do not pay any amounts by the time payment is due, we reserve the right to treat your booking as cancelled by you. In this case, the cancellation charges in clause 5 below will be payable.

You must pay a damage deposit of £150 with the final balance payment unless otherwise agreed with Las Ramblas on our behalf. The cost of any loss or damage to the Property or to any items in and/or at the property caused or any service charges incurred by you (for example telephone calls) will be deducted by us from the damage deposit at the end of your stay. If no deductions are required your damage deposit will be refunded to you in full after your stay. If the damage deposit is not sufficient to cover any damage caused or service charges incurred, you will be responsible for paying Las Ramblas on our behalf any additional moneys required immediately on request.

3. Your contract

When Las Ramblas on our behalf issues a written confirmation to you, this signifies that we have entered into a contract with you, subject to these Booking Conditions. This Agreement and all matters arising out of it shall be construed and governed by English Law and shall be subject to the exclusive jurisdiction of the Courts of England and Wales in relation to any dispute.

4. Access to the Property

You shall normally have access to the Property from 2.30pm on the arrival date and must depart by 10.30am on the departure date. We shall not be obliged to offer access to the Property before the time stated and you shall not be entitled to remain in the Property after the departure time stated unless otherwise specifically agreed.

5. Changes and cancellation by you

Should you wish to make any change to a confirmed booking you must contact Las Ramblas on our behalf. Neither Las Ramblas nor ourselves can guarantee a request will be met. Where Las Ramblas or ourselves can meet a request, any additional costs incurred to meet the change may be charged to you and Las Ramblas may charge an administration fee of £25.

Should you need to cancel the booking once it has been confirmed, you must notify Las Ramblas on our behalf (by e-mail preferably). Notice of cancellation is effective only when Las Ramblas on our behalf receive it in writing. The following cancellation charges will be payable:

Cancellation charge

More than 8 weeks – Full amount of deposit only

Between 4 and 8 weeks – Full amount of deposit and 50% of balance of booking price

Between arrival date and 4 weeks – Full amount of deposit plus balance of booking price

Depending on the reason for cancellation, you may be able to reclaim the charge under the terms of any insurance policy you may have. You should contact the insurance company directly.

6. Changes and cancellation by Owner

Neither we nor Las Ramblas expect to have to make any changes to your booking but occasionally problems occur and bookings have to be cancelled or changed. If this does happen, Las Ramblas on our behalf will contact you as soon as is practicable. Las Ramblas will endeavour to offer you an alternative property at the same price band should a significant change or cancellation occur. If you do not wish to accept a significant change or alternative property you will receive a full refund of monies paid to Las Ramblas on our behalf.

We regret that neither we nor Las Ramblas can pay any additional expenses, costs or losses incurred by you as a result of any change or cancellation.

7. Insurance

It is recommended that you take out adequate travel insurance. It is your responsibility to ensure that the cover you purchase is adequate for your particular needs so please read policy details carefully.

8. Force majeure

Except where otherwise expressly stated in these conditions, we and Las Ramblas shall not be liable, jointly or individually, where the performance or prompt performance of our or Las Ramblas’s contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of force majeure. “Force majeure” means any event which we or Las Ramblas could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

9. Liability

We promise to provide Property with reasonable skill and care. No liability for death, personal injury, failure or deficiency in the Property or loss (for example loss of enjoyment) or claim of any description is accepted by us or Las Ramblas except where either the Owner, Las Ramblas or either of its employees (whilst acting in the course of their employment) were negligent. You must take all steps to safeguard your personal property. No liability is accepted by the Owner or Las Ramblas in respect of damage to, or loss of, such personal property except where either the Owner, Las Ramblas or either of its employees (whilst acting in the course of their employment) were negligent.

As Las Ramblas acts only as agent for the Owner, Las Ramblas cannot accept any liability for any acts or omissions of the Owner or anyone employed by the Owner, including any shortcomings or defects with or in the Property.

Please note that neither us nor Las Ramblas accepts any responsibility for any services that do not form part of this contract. This includes, for example, any additional services or facilities any other supplier agrees to provide to you.

We and Las Ramblas limit the maximum amount we may have to pay you for any and all claims (except those for personal injury or death caused by negligence as described above). Our maximum liability shall be the amount paid by you for the booking. The maximum liability of Las Ramblas shall be the amount of commission made on the booking. Such amounts will only be payable where everything has gone wrong and you have not received any benefit at all from your stay.

10. Problems and complaints

Every effort has been made to ensure you have an enjoyable holiday. If, however, you have any complaint you must contact Las Ramblas on our behalf so that they can liaise with us and ensure remedial action is taken. Discussion of any criticisms during your holiday will often result in the matter being rectified straightaway – until we know about a problem we cannot begin to resolve it. We regret that neither we, nor Las Ramblas, can accept responsibility for complaints not notified to Las Ramblas in writing within 14 days of the end of your booking. Any assistance provided by Las Ramblas in resolving a complaint is provided on a goodwill basis and in their capacity as our agent.

11. Your behaviour

You accept responsibility for any damage or loss caused by you, as further set out in clause 2 above. If you fail to pay any sums so demanded you will be responsible for meeting any legal costs we incur in full in recovering full payment from you.

You agree to keep the Property clean and tidy and to leave it in a similar condition as you found it upon arrival. You agree not to use the Property for any commercial purpose.

You must allow the Owner or any representative of the Owner access to the Property at any reasonable time during your occupation of the Property. Where access is required in an emergency, or you cannot be contacted, the Owner is entitled to enter the Property without prior notice.

We expect you to have consideration for other people – such as our neighbours and other holidaymakers. If in our reasonable opinion, or that of any other person who contacts us, you behave in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to the Property or in any way damage the reputation and/or goodwill of the Owner we are entitled without notice to terminate the occupation of the person(s) concerned. We will require such person(s) to leave the Property and we will have no responsibility towards such person(s). No refunds nor expenses or costs incurred as a result of the termination will be made by us nor Las Ramblas on our behalf.

12. Special requests and medical problems

If you have any special request you must advise Las Ramblas at the time you request property availability. Although we will endeavour to meet them, we cannot guarantee any request will be met. Failure to meet a special request will not be a breach of contract on our part.

If you have any medical problem or disability that may affect your stay, please advise Las Ramblas in writing at the time you request property availability, who will discuss your needs with us. If we reasonably feel unable to accommodate these needs we reserve the right to decline the booking or, if full details are not provided in writing at the time of booking, cancel when we become aware of these details.

13. Website accuracy

Every effort is made to ensure the accuracy of the information within LasRamblas.info, however, regrettably errors do occasionally occur. You must therefore check all details of your booking, including the price, carefully. There may be small differences between the actual property and its description, as both us and Las Ramblas are continuously seeking to improve services and facilities. Occasionally, problems mean that some facilities or services become unavailable or subject to restriction. If this happens Las Ramblas will inform you once Las Ramblas is aware of the situation. Neither the Owner nor Las Ramblas can accept responsibility for changes to or closures to amenities or attractions appearing in LasRamblas.info.

14. Passports and visas

It is your responsibility to ensure you have all necessary travel (including passports and visas) and health documentation before you travel.
